Finally Apple has been renounced the rights for the iPad trademark in China in a legal war with Proview Technology that is a Hong-Kong based technology company and that registered the trademark in 2000, according to the report. At the center of disagreement is whether or not a 2006 agreement between Apple and Proview’s Taiwan based subsidiary, Proview electronics to sell the global trademark for the iPad name for $54,000, according to the report from the Financial Times.
There is a conflict on the agreement. Apple says that the agreement should include the trademark rights in China but Proview disagrees, according to Reuters reported. Proview is insisting that the iPad trademark in China owned by its Shenzen-based company, the trademark that is formally owned by Proview Electronics is different than the trademark of Proview Technology, the reporters said.
Apple has lodged a complain in the Shezhen Intermediate People’s Court against Proview technology, and the court has rejected Apple’s ownership claim, The Financial Times said. Proview Technology has said Apple resellers in china in an attempt to block the sale of Apple’s iPad tablets. Proview Technology also lodge a complain against Apple questing $1.5 billion from Apple over declared infringement over its Chinese iPad trademark, reporter said.
Despite of this legal war , Proview spokesperson LI Su said to the Financial Times that the company is ready to settlement and we hope that this decision will make our negotiations with Apple a bit easier.
